Melbourne man stuck in India takes Australian government to court

The Morrison Governments travel ban on India is being challenged in the Federal Court by Melbourne man Gary Newman who has been stuck in India since March 2020. The legal argument is based around the constitutional validity of the emergency declaration made under the Biosecurity Act by the Federal Government.

My opinion is despite what we might think of Australians that are in India at the moment it is still crucial to check and challenge actions by governments that can have wide ranging consequences on individual freedoms and set unwelcomed precedents which could be abused in the future.

It’s important that we know clearly what powers a government can exercise lawfully, especially when making decisions that determine their moral, ethical and legal obligations towards Australian citizens abroad and at home.
